There doesn't seem to be anything to suggest it damaging the tailgate in the user manual: After the tailgate has opened, it can be manually lowered. If the tailgate fails to open or close correctly, close it manually, then press the exterior release button (1) again. http://www.ownerinfo.jaguar.com/...

Not sure as to the function of the power button but it should remain silent if you turn the volume round to 0... I've got into the habit of doing it but it's a bit of a pain!

I bought mine late January and they had around 20 400's just sat at Castle Bromwich... Was looking at a 380 but ended up getting a 400 for £16k under list price.
