Does the fuse have to go back in to pass an MOT (just thinking of emissions tests)?

The boot spoiler is in an odd position. It should either be all the way up or down. I've never seen one 'ajar' before.

I looked through all of the V8s on Autotrader to find a pic and only 2 were debadged out of nearly 30 so you're more likely to see the AWD badge than not.
