It is a design fault with the original seals, not a wear and tear issue. The replacement seals are of a new design according to my dealer.
A quick chat with your dealer should clarify this.

So I called the Service advisor at my local Dealer who knows me as a customer, and she said straightaway that it was covered. But she couldn't get me in until mid March so I've called Jag Assist who are coming out tomorrow. If they say it's ok to drive (I noticed I have drips around the size of 50p on my driveway), then I'll drive it and if the diff gets damaged I'll have comeback. Likely that they'll get me into a courtesy car for a couple of weeks which is fine by me.

I had a XF courtesy car whilst they did the seals but as they messed that up and it needed a new diff, Jaguar said as my car was an "S" I had to have a similar car. So they sent down an XE 380S, which I had great fun playing with.
Push for something nice, you never know what they may provide.

Quick update - Jag Assist came out yesterday and said I shouldn't drive it so got me into a hire car (BMW 3 series!). Dealer confirmed that the fault is covered under Extended Warranty and bumped me up the queue so my car will be ready early next week.

Good news, but poor planning getting you into a BMW rather than a Jaguar!

Do you know if they are just replacing the seals or the whole diff?

It's a Thrifty Hire car. No courtesy cars were available and their priority was to get me into any car rather than be without one, which is fine by me tbh.

They said they are replacing the seal rather than the diff. Mine isn't noisy so assuming they don't overtighten it I should be fine!
